Automated License Plate Recognition (ALPR) Usage And Privacy Policy

South Coast Plaza (“SCP”) uses Automated License Plate Recognition (“ALPR”) technology at the South Coast Plaza shopping center (“SCP Shopping Center”). This technology consists of a system of cameras and associated software that capture and process license plate information (“ALPR System”). SCP’s ALPR System is installed at entrances and exits of the SCP Shopping Center parking facilities.

SCP may update this policy at any time, in which we will update the “Last Revised” date at the top of this policy, and any changes will be effective as of that date. If we make material changes to this policy, we will use reasonable efforts to notify you in accordance with applicable laws.

DATA COLLECTION

The following data may be collected using SCP’s ALPR System (collectively, “ALPR Data”):

  • License plate numbers and license plate state;
  • Video, still images, and audio recordings of vehicles (and surroundings); and
  • Date, time, and geographic location associated with each of the categories of data listed above.

PURPOSE

ALPR Data may be accessed and used for the following purposes:

  • To enhance public safety and security, including by investigating incidents such as theft, vandalism, or trespassing;
  • To manage parking operations and enforce parking policies;
  • To identify stolen vehicles and report them to law enforcement; and
  • To cooperate with law enforcement agencies, government requests, subpoenas, court orders, or valid legal process.

AUTHORIZED PARTIES

Access to ALPR Data is limited to SCP’s Security and Information Services personnel (“Authorized Users”).

Authorized Users are required to complete privacy and information security training before they may access ALPR Data, which addresses the handling of ALPR Data to protect privacy interests and comply with applicable laws.

DATA RETENTION

ALPR Data is retained for approximately 30 days, except as needed in connection with legal obligations and proceedings, active investigations, or managing parking operations and policies. After the retention period expires, we take steps to securely delete or anonymize the ALPR Data.

DATA SHARING

SCP does not sell, lease, or otherwise commercially distribute ALPR Data. ALPR Data may be shared with third parties in limited circumstances, including:

  • To law enforcement or other governmental authorities.
  • With our service provider for the ALPR System (currently Flock Group, Inc. d/b/a Flock Safety), which is shared subject to any confidentiality agreement between SCP and our service provider.
  • To third parties in connection with, or anticipation of, an asset sale, merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of all or some of our assets; or as needed to support auditing, compliance, legal, or corporate governance functions.

DATA SECURITY

SCP implements reasonable security measures designed to protect ALPR Data, including:

  • Encryption and secure storage;
  • Network and system access controls; and
  • Monitoring for unauthorized access to ALPR Data.

SCP also conducts periodic audits of the ALPR System to examine whether ALPR Data is collected and used in compliance with SCP’s policies, procedures and applicable laws.

DATA ACCURACY AND CORRECTION

SCP conducts regular testing and regularly reviews ALPR Data for accuracy. This includes performing visual audits on a monthly basis to ensure that cameras are angled correctly and visibility is good.  On a monthly basis, tests are run to ensure that the system is accurately reading license plates, including by cross-referencing between vehicles driven onto the property and the corresponding plate number shown in the system.  On the same cadence, tests are run to ensure that relevant license plate numbers accurately trigger a notice to SCP that the vehicle is present at the SCP Shopping Center.

OFFICIAL CUSTODIAN

The official custodian of ALPR Data and SCP’s ALPR System is SCP’s General Manager.
